MITREX IP Policy

I understand and agree to the following:

  1. UPLOADING CONTRIBUTIONS: For good and valuable consideration, the receipt of which I hereby acknowledge, I (the “Contributor(s)”) grant to the Massachusetts Institute of Technology on behalf of its Center for Real Estate (“MIT”) a perpetual, royalty free, non-exclusive license to use, reproduce, and distribute and permit others to download via the MITREX (“MITREX”) Web site any and all materials provided by me as contributions to MITREX (the “Contributions”). MIT shall also have the right to modify and create derivatives of the Contributions solely to the extent necessary for the Contributions to be incorporated into MITREX.
    I understand and agree that each Contribution shall be submitted pursuant to an Addendum to this agreement that shall be entered into electronically, and I agree that the terms of each such Addendum shall be and hereby is specifically incorporated into this Agreement.
  2. MITREX USE I understand and agree that through MITREX, the Contributions will be available to third party members of MITREX who will be granted a perpetual, royalty free, non-exclusive license to use and reproduce the Contributions for personal, educational and non-commercial purposes, but not for monetary gain.
  3. ACCURACY OF CONTRIBUTIONS: I acknowledge and agree that I am solely responsible for the correctness of my Contributions, their adherence to academic standards, and their accurate reflection of the content presented.
  4. ATTRIBUTION: I understand that MITREX will attribute any use of any of the Contributions in a form that will include my name, my organizational affiliation, and the date that the material was posted. MIT agrees that it will not post my email address or any other direct contact information.
  5. STATUS OF COPYRIGHT: MIT acknowledges and agrees that nothing in this license will constitute a transfer or assignment of the copyright in the Contributions to MIT. MIT further acknowledges that I will continue to own any copyright that I currently hold in any of the Contributions.
  6. AUTHORITY AND THIRD-PARTY PERMISSIONS: I hereby represent that I either hold the copyright to the Contributions that I submit or that I have obtained permission from the copyright holder. I understand that even if I am the author of the Contributions, if the Contributions have been previously published the publisher may hold copyright to the works and I represent that I have obtained any necessary permissions from any such publishers. If any Contributions are based upon work that I completed from a grant or agreement sponsored by a third party, or a previous or current employer other than MIT, I further represent and warrant that I have fulfilled any right of review or other obligation required by such contract or agreement and further that my Contributions will not violate any agreement to which I am a party or infringe any third partyÕs rights.

    Important: Unauthorized use of third-party copyrighted work is illegal, unethical, raises significant financial liability, and damages the reputation of MIT. Contributors must exercise scrupulous care to identify the source of every third-party owned element in the Contributions.

I have voluntarily chosen to participate in the MITREX system. This Agreement shall be construed, governed, interpreted and applied in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
